Beamroll Terms of Service

These Terms of Service ("Terms") govern your use of Beamroll (the iPhone app and the Mac app, together the "App") provided by us ("we"). By using the App you agree to these Terms.

Section 1 (Scope)

These Terms apply to all aspects of the relationship between us and you regarding use of the App.

Section 2 (Eligibility)

  1. The App is used as a pair of an iPhone app and a Mac app.
  2. The terms of the store from which you obtained the App, if any, also apply.
  3. The App is intended for:
    • iPhone: iOS 17.0 or later
    • Mac: macOS 14.0 or later
    • An iPhone and a Mac connected to the same network

Section 3 (Price and Pro)

  1. The App is free to use. The free version sends up to 10 photos a day. A day ends at midnight in the time zone set on the iPhone.
  2. The count is the number of photos newly placed on the Mac (resending a photo the Mac already has, and files of text read from photos, are not counted). Photos chosen beyond the day's remaining count are not sent and stay selected.
  3. Buying Pro (a one-time in-app purchase) in the iPhone app removes the limit in the preceding two items. The limit is the only thing Pro changes.
  4. The price of Pro is the price shown on the App Store. Buying Pro, payment, restoring purchases, and refunds follow Apple’s procedures.

Section 4 (License)

  1. We grant you a non-exclusive, non-transferable license to use the App in accordance with the standard end-user license of each distribution platform.
  2. You may use the App for personal or internal business purposes.
  3. Copying, modifying, reverse engineering, or redistributing the App in whole or in part is prohibited (except as permitted by platform terms and applicable law).

Section 5 (Prohibited Conduct)

  1. Using the App in violation of law or public morals
  2. Taking, sending, or storing photos that infringe others' intellectual property, likeness, or privacy
  3. Attempting to modify, decompile, or reverse engineer the App, except as permitted by applicable law
  4. Connecting someone else's iPhone or Mac with the App, or sending or receiving photos with it, without the owner's permission

Section 6 (Rights to Photos and Text)

  1. We acquire and claim no rights in the photos you send or store with the App, or in the text read from them. Rights in any works contained in those photos remain with their respective owners.
  2. You are responsible for ensuring that your taking, sending, and use of photos does not infringe third-party rights.
  3. We have no access to your photos or the text read from them and assume no responsibility for their contents.

Section 7 (Disclaimer)

  1. We make no warranty regarding the quality, accuracy, or usefulness of the App, including the accuracy of text read from photos.
  2. For damages you incur from using or being unable to use the App, except in cases of our willful misconduct or gross negligence, we are not liable for lost profits or other damages arising from special circumstances, and our liability is limited to damages that would ordinarily arise. The limitation in this item applies only to damages caused by our ordinary negligence (negligence other than gross negligence) and does not apply in cases of our willful misconduct or gross negligence.
  3. The App places photos from your iPhone into a folder on your Mac, but photos may fail to arrive or be lost due to interrupted connections, disk failure, OS upgrades, or user action. You are responsible for backing up important data.

Section 8 (Updates and Discontinuation)

  1. We may update, add, remove features, or change pricing without notice.
  2. We may discontinue the App for legitimate reasons.

Section 9 (Privacy)

Handling of your privacy is governed by the separatePrivacy Policy.

Section 10 (Changes to These Terms)

We may amend these Terms in accordance with Article 548-4 of the Civil Code of Japan. When we do, we will post the amended Terms and their effective date on this page before that date.

Section 11 (Governing Law and Jurisdiction)

  1. These Terms are governed by the laws of Japan.
  2. Disputes shall be submitted to the exclusive jurisdiction of the district court having jurisdiction over our place of business as the court of first instance.
